Average rates for 30 year fixed mortgages slipped by stayed above 5% for the 5th straight week.  The average rate for 30 year fixed mortgages was 5.06 % last week, down from 5.07 % the previous week.  A year ago this same rate was 4.84 percent.  Rates on 5 year adjustable rate mortgages averaged 4% down from 4.03 % a week ago.

Larkspur Property Owner's Property Rights Challenged by Marin Courts

On April 28th the Marin Independent Journal reported on an ongoing dispute between Anne Wolff and her neighbor's Michael and Joni Mindel's efforts to have her cut down 28 or her 45 Eucalyptus trees. Marin Superior Court Michael Dufficy has ruled the trees are a "clear and continuing hazard." Anne Wolff has said she will appeal the decision to the State Supreme Court, and she should.

Wolfe's attorney, Michael J. Coffino, said important legal issues are at stake. "The case addresses the standard by which property owners should be held accountable in their ability to control Mother Nature.  If every property owner is responsible for the vagaries of Mother Nature, we have gone down a slippery slope."   Anne Wolff says that since her neighbor's moved into her neighborhood, "the fact of the matter is that after 14 years there has not been one cent of damage" to the neighbors.

What do you think?  This appears to be a violation of someone's property rights.  If this passes all kinds of lawsuits pitting neighbors against one another will take place. Is this situation unique?  Or a potential disaster for property owners thoughout Marin, and California.

Marin City Real Estate in the News!

4.27.2010 The Marin Independent Journal reported that the Gateway Mall in Marin City is Up for Sale.  The center at 100 Donahue Street anchored by CVS, Best Buy, the Outback, and Ross is owned by the Marin City Community Development Corporation and the Pacific Capital Partners Bay Area Smart Growth Fund, which place investments in underserved urban area.  It is being sold based on the best offer received.  The 182,030 - square foot center is anticipated to fetch around 40 million dollars.

The shame is that all efforts to make something good happen here, and help the neighboring community has always resulted in a small number of local individuals, primarily gangs and people that congregate there without actually ever shopping there,continue to sabotage efforts to attract people to the Mall, and have contributed greatly to it's demise.  With all the crimes and shootings that have taken place at the Bus Stop most people have been scared off  from going there to shop.  The actions of a few have irreparably damaged the Gateway Mall, and their own neighborhood. The negative impact on Condominium sales further up Donahue Street has been significant.
